BESPOKE/ MADE TO MEASURE
2.1. Defined terms
2.1.1. “Goods” is to mean those products made available by IZMAYLOVA Ltd (also referred to as ‘We’, ‘Us’ a ‘Our’ and ‘IZMAYLOVA’) that the customer (also referred as ‘You’) wishes to purchase.
2.1.2. “Order Form” is to mean those orders placed online using the process as provided on the Site and “Order” shall be interpreted accordingly.
2.2. Terms of agreement
2.2.1. These terms and conditions apply to all bespoke goods that IZMAYLOVA have made available at your request. The order of bespoke goods are subject to these terms and conditions exclusively and not subject to any other terms and conditions otherwise implied save for any terms, conditions or warranties implied by law.
2.3. Customer Obligations
By placing an order you warrant, represent and undertake:
2.3.1. That you are acting within your capacity as an individual consumer and that the Goods or any part of the Goods shall not be used for commercial, professional or anything other than ordinary personal use;
2.3.2. To supply, true, accurate, current and complete information;
2.3.3. That you are the authorised holder of any credit/debit card you may use on the Site;
2.3.4. That you are of sufficient legal age to enter into a binding commitment for the purchase of Goods; and
2.3.5. To be available and receive the delivery of Goods ordered by you.
2.4. Our Obligations
2.4.1. We are not obliged to accept any orders or sell any goods to you under these terms and conditions until we enter a legally binding contract by form of offer acceptance as per section 2.5.3.
2.5. Order of Goods
2.5.1. All of our bespoke goods are designed and modified in their entirety by hand at IZMAYLOVA’s workshop to your requested specifications.
2.5.2. Your submission of the Order Form represents an offer to purchase the Goods from our website www.izmaylova.co.uk .
2.5.3. There will be no binding contract between you and IZMAYLOVA for the supply of Goods unless and until IZMAYLOVA Ltd has accepted, by form of confirmatory email, that your order is valid and confirming the Goods to be supplied and the price payable once your order has been processed.
2.5.4. We will not be liable to carry out any work prior to the time of contractual engagement; any such work carried out is done so in our sole discretion.
2.5.5. No change to any order shall be binding on IZMAYLOVA Ltd unless such a change is accepted and agreed by IZAMYLOVA in writing.

2.5.7. Any information that you submit to us shall be dealt with in accordance with our Privacy Policy .
2.6. Limitations of Supply and Exclusions
2.6.1. We shall make every effort to ensure that all orders are fulfilled; however we cannot guarantee the availability of Goods.
2.6.2. In the event of Goods being unavailable, a member of staff shall contact you by email and Izmaylova Ltd, may at its sole discretion, provide replacement Goods of an equivalent value, quality and/or specification or a full refund, subject always to your right to reject the goods under Clause 2.10.1.
2.7.Prices and Payment
2.7.1. Subject to Clause 2.7.3. , the price payable by you for the Goods shall be the price state at the time of order, as confirmed in accordance with Clause 2.5.3. , of these Terms and Conditions. Notwithstanding the price information given on the website, we reserve the right to change the price of the products at any time before an order is placed.
2.7.2. Payments to be made through www.izmaylova.co.uk . Payment can be made by:aVisa, Visa Electron, Visa Debit, Visa Delta, MasterCard, American Express, Maestro debit cards, and any other methods which may be clearly advertised on the Site from time to time.
2.7.3. Payments will be processed when your order is accepted by us, during normal UK business hours (next day processing will apply to orders made outside business hours). Prices stated are in GBP only and you will be charged in GBP only.
2.7.4. IZMAYLOVA Ltd/ www.izmaylova.co.uk will aim to ensure the accuracy of the prices and price related information stated. However, you may encounter items that have been mis-priced on the website. We will verify prices in accordance with clause 2.3.2. , of these Terms and Conditions.
2.7.5. If an item is mis-priced, we will give you the option of correcting your order or cancelling it. If we are unable to contract you or do not receive a response from you within seven (7) days, we will treat the order as cancelled.
2.7.6. Delivery is free of charge, however where orders exceed the maximum weight and /or cubic weight determined by the carrying courier company the delivery charges will be calculate at the courier’s rates.
2.7.7. All prices stated are inclusive of Value Added Tax (“VAT”) where applicable.
2.8. Delivery and Carriage
2.8.1. We will arrange delivery of goods to addresses within the UK. Following acceptance of your Order in accordance with Clause 2.5. , of these Terms and Conditions We will, by separate shipping email, notify to you of delivery details including tracking number and estimated delivery time. We shall use reasonable endeavours to deliver the Goods (which are in stock and available for delivery) within 6 weeks, always provided that we cannot guarantee delivery within these timeframes and shall not be liable for failure to deliver within such estimated delivery time period.
2.8.2. Unless otherwise stated in writing, delivery of the Goods shall take place Monday through Friday excluding holidays, and at the delivery or alternative delivery address taken at the time of order no later than forty-five (45) days following acceptance of your Order. For security reasons, we cannot deliver to PO Boxes or APO/FPO addresses, which are not available through the chosen courier service. A shipping confirmation is emailed to you as soon as your purchase has been shipped. On occasion, packages may be returned to us (or its agent) as undeliverable (in accordance with the delivery policies of the courier service and, in particular, where three or more unsuccessful delivery attempts have been made). If you receive a notice from the carrier that a package has been returned to us as undeliverable, please contact us to make arrangements for reshipment. Further charges may become applicable for re-delivery.
2.8.3. We reserve the right to require the return of Goods that are not accepted by you for any reason.

2.9. Inspection & Defects
2.9.1. Upon delivery of the Goods you must carefully inspect them. If any of the Goods do not match the description or prescription or appear to be damaged or are lost, do not use the Goods and please contact us by telephone or email and inform us of the problem immediately.
2.9.2. You further agree to immediately notify us if there are any defects in the Goods which are apparent through use.
2.9.3. We shall accept the return of defective Goods at your cost (subject to Clause 18.3 below), and shall, at its sole discretion provide a refund or replacement.
2.9.4. Replacement products shall be charged (including delivery) until the returned Goods are received by us. If we agree to provide you with a refund, the credit will be paid via the method originally used by you to purchase the Goods.
2.10. Your Right to Cancellation
2.10.1. You may cancel your Order, without reason, until the expiry of twenty-four (24) hours from the day after the date of receipt of Order Confirmation by you. Cancellation of an Order will only be effective by contacting us by means of the details given on theaContact Usa(hyperlink)apage. If you cancel an Order after receipt of the Goods you must return the Goods to us in accordance with the procedure outlined in Clauses 2.103. and 2.10.4.
2.10.2. We want to ensure your complete satisfaction. The name of Izmaylova Ltd stands for craftsmanship, luxury and meticulous attention to detail, which are qualities seen in everything we do. We trust you will be entirely satisfied with your purchase. If for any reason you are not, please do not hesitate to return it for a full refund in accordance with Clause 2.10.1.
2.10.3. Refunds will include the total price paid for the Goods, and the cost of return if returned from a delivery address within Europe, but will not include the stated delivery costs unless:
(i) there is a defect in the Goods; or (ii) you exercise your statutory right to cancel your Order. (iii)Where Clause 2.10.3. (i) or (ii) applies, the stated delivery costs will also be refunded to you.
2.10.4. Easy to follow instructions for returning merchandise are included with each shipment. Every effort will be made to ensure a prompt refund and send an email notification once the return has been processed. |
